Terms of Service
Last updated: 2026-11-01
In plain language: Design Theater is a free, community-run gallery for prompts, skills, and vibe-coded apps. You keep your copyright. You use the platform at your own risk. We may remove content or accounts that break the rules. If anything in these Terms is unclear, read the plain-language summary at the top of each section.
1. Acceptance of these Terms
By creating an account, signing in, posting content, or otherwise using Design Theater (the "Service"), you agree to these Terms of Service ("Terms") and to our Privacy Policy. If you do not agree, do not use the Service.
These Terms form a binding agreement between you and the operators of Design Theater ("we", "us", "our"). We may update these Terms from time to time. Material changes will be announced on the site at least seven days before taking effect. Continued use after that date constitutes acceptance of the new Terms.
2. Who may use the Service
You must be at least 13 years old, or the minimum digital-consent age in your jurisdiction, whichever is higher. If you are under 18, you confirm that your parent or legal guardian has reviewed and accepted these Terms on your behalf.
You may not use the Service if you have been previously banned, suspended, or had your content removed for serious abuse, unless we expressly agree in writing.
You are responsible for every action taken through your account. Keep your password confidential. Report compromised accounts to us immediately via /report with kind "id_theft".
3. Your content and the license you grant us
You keep all intellectual property rights in content you upload, including prompts, skills, descriptions, files, screenshots, comments, and chat messages ("Your Content").
To operate the Service you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to:
- host, store, cache, reproduce, publicly display, and distribute Your Content inside the Service,
- let other users clone, fork, remix, or download Your Content inside the Service (including the "Fork to GitHub" and "Download zip" features),
- create thumbnails, previews, and derivative representations needed for discovery (search indices, OG images, feed cards),
- share Your Content with service providers (hosting, email, moderation) acting on our behalf.
This license lasts until you delete the content or close your account. We may retain cached copies for a short period for operational reasons (CDN cache, backups up to 30 days).
You may not upload content you do not have the rights to share. If you upload third-party content under a permissive licence (for example MIT or CC-BY), you must preserve the licence and attribution.
4. Prohibited content and conduct
You must not post or do any of the following:
- Harass, bully, threaten, impersonate, or dox any person.
- Share personal data of yourself or others, including email addresses, phone numbers, physical addresses, or government-issued identifiers. The site actively filters these in chat and threads.
- Publish sexual content involving minors, or any content that is unlawful where you live or where the content is accessible.
- Distribute malware, viruses, phishing payloads, cryptominers, keyloggers, or any code intended to cause harm.
- Scrape the Service, bypass rate limits, evade moderation, or operate automated accounts without our written permission.
- Use the Service to coordinate illegal activity, incite violence, or promote hate against a protected group.
- Infringe copyright, trademark, trade secret, or other proprietary rights. See DMCA for the takedown process.
- Attempt to reverse engineer, decompile, or probe the Service for vulnerabilities except through a responsible disclosure programme we have opened publicly.
We may remove any content, suspend any account, or terminate access at any time, with or without notice, when we reasonably believe the Terms were broken or when required by law.
5. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED, SECURE, OR ERROR-FREE OPERATION.
We do not warrant that:
- the Service will be available, timely, or free from bugs,
- data you upload will not be lost, altered, or deleted,
- content posted by other users is accurate, safe, or lawful,
- any specific feature will continue to be available in future versions.
6. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE, OUR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, INCLUDING WITHOUT LIMITATION:
- loss of profits, revenue, goodwill, use, or data,
- cost of substitute services,
- unauthorised access to or alteration of Your Content,
- any damages resulting from other users' content, including forks, remixes, or derivative works,
- any damages caused by third-party services we integrate with (Supabase, Vercel, EmailJS, Cloudflare, GitHub, Google),
- any damages caused by downtime, maintenance, or security incidents.
Because the Service is free, our aggregate liability to you for all claims arising from or related to the Service is limited to zero (0 USD).
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for consequential or incidental damages, so some of the above may not apply to you.
7. Indemnification
You agree to indemnify, defend, and hold harmless Design Theater and its operators from any claim, demand, loss, liability, cost, or expense (including reasonable legal fees) arising out of or related to:
- Your Content,
- your use or misuse of the Service,
- your violation of these Terms,
- your violation of any third-party right, including intellectual property or privacy rights.
8. Suspension and termination
We may suspend or terminate your account at any time for any reason, including if we believe you have broken these Terms. We may also remove or disable Your Content without notice.
You may close your account at any time from Profile → Settings → Danger zone. Account closure removes your profile row, projects, files, chats, follows, likes, and comments. Some records may remain in backups for up to 30 days.
If we suspend you for a repeated or severe violation, you may not create a new account to circumvent the suspension.
9. DMCA and copyright
If you believe content on the Service infringes your copyright, send a DMCA takedown notice following the process in DMCA. We respond to valid notices and forward counter-notifications per the DMCA process.
10. Governing law and dispute resolution
These Terms are governed by the laws of your jurisdiction of residence. Any dispute will be resolved in the competent courts of that jurisdiction unless local law requires otherwise. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Nothing in this section limits your statutory consumer rights.
11. Changes to these Terms
We may update these Terms. When we do, we will revise the "Last updated" date at the top. Material changes will be announced on the site and by email where possible. If you keep using the Service after the effective date, you accept the updated Terms.
12. Contact
Questions, complaints, or formal notices should go to /report with the matching kind. For legal notices, mention "LEGAL" in the subject.
